Representation of high school, college, and professional athletes sits at the intersection of NIL law, NCAA rules, state high school associations, league agent regulations, and minor protections. This overview explains how PROVN navigates that framework.

Regulatory Framework
PROVN Sports operates in a multi-layered regulatory environment. At any given time, a PROVN athlete may be subject to some combination of:
- State NIL statutes in the athlete's state of residence, school enrollment, and any state where deals are executed
- NCAA rules for college-bound and collegiate athletes
- Conference-specific NIL and compliance rules
- National Federation of State High School Associations (NFHS) rules and state-level high school association rules (for example, OSSAA for Oklahoma; KSHSAA for Kansas)
- Federal laws including COPPA, FTC endorsement guidelines, Truth in Advertising rules, and tax reporting obligations
- NFLPA, NBPA, and league-specific agent regulations for professional representation
- International federations, visa, and tax rules for non-US athletes
PROVN maintains ongoing awareness of these frameworks through internal review, engagement with outside counsel where appropriate, and consultation with school compliance officers for current college athletes.
NIL Compliance
NIL representation is the core of PROVN's current service offering. Every NIL deal we source and structure is reviewed against:
- Applicable state NIL law and regulations
- The athlete's school or institution NIL policy (where applicable)
- The athlete's conference NIL policy (where applicable)
- Prohibited-category lists relevant to the athlete's age and school
- Exclusivity, term, territory, and renewal provisions
- FTC endorsement disclosure requirements, including clear #ad or #sponsored labeling
- Tax reporting and 1099 obligations for athletes receiving over applicable thresholds
PROVN does not structure pay-for-play arrangements, inducement payments, or any deal that would compromise an athlete's eligibility or integrity.
NCAA & Collegiate Rules
For athletes who are or may become NCAA student-athletes, PROVN coordinates closely with the athlete and, where appropriate, with the institution's compliance office to ensure NIL activity conforms to current NCAA bylaws and case-by-case interpretations, which continue to evolve.
PROVN does not hold itself out as a certified contract advisor for NCAA Division I athletes in sports that require such certification for NIL representation; we work within each athlete's institutional framework and disclose our role transparently.
High School Rules
PROVN represents high school athletes subject to the rules of the athlete's state high school association. We confirm NIL permissibility, scope limitations, and reporting requirements before executing any deal.
For high school athletes, PROVN additionally requires:
- Written parent or guardian consent for representation and for each deal
- Confirmation that the deal does not violate the athlete's state high school association rules
- Clear separation between the athlete's team, school, and uniform identity and the commercial deal
- Age-appropriate deliverables and commercial categories
Professional Agent Certifications
Professional league representation requires specific certifications. PROVN's stated certification roadmap is:
- NFLPA Contract Advisor certification for NFL player contract representation
- NBPA Certified Agent status for NBA player contract representation
- NFL agent certification for marketing representation of NFL players
- State agent registration in Kansas, Oklahoma, and other operating jurisdictions as required
Until these certifications are issued to the relevant agent of record, PROVN does not negotiate standard league player contracts on behalf of athletes, and will partner with or refer to certified counsel when a client transitions to the professional level before our certifications are complete.
Minor Athlete Protections
A significant portion of PROVN's current roster is under 18. Protecting minor athletes is non-negotiable and built into every step of our process.
- Parental or legal guardian consent in writing is required before any representation relationship begins
- We strongly recommend, and will facilitate introductions to, independent legal counsel for the minor and family when reviewing the representation agreement and individual deals
- Contracts involving minors may require court approval in certain jurisdictions (for example, Coogan-style protections for significant earnings). Where applicable, PROVN supports that process
- Minor athletes are shielded from contractually committed content or appearances that are age-inappropriate, exploitative, or conflict with school, family, or faith boundaries
- Personal information about minors is handled under our Privacy Policy and COPPA-aligned practices
Media & Likeness Rights
Under every PROVN representation agreement, the athlete retains ownership of their name, image, likeness, and personal brand. PROVN holds a limited, revocable license to use athlete NIL for the specific purposes of:
- Marketing and promoting the athlete
- Sourcing and negotiating deals on behalf of the athlete
- Producing agency-commissioned content with athlete approval
- Operating the athlete's PROVN-built website and identity assets
Brand deals are structured so that the brand receives a defined, term-limited license to use athlete NIL for specified deliverables and territories. Perpetual, irrevocable, or open-ended NIL grants are generally declined.
For minor athletes, all NIL licensing provisions require parental or guardian signature in addition to the athlete's signature.
Content & Licensing
Content produced in connection with PROVN services (photography, video, website assets, social assets) is generally structured so that:
- The athlete owns their personal identity content and receives a perpetual license to use it
- PROVN retains a license for agency marketing and case-study use, subject to athlete approval of specific public uses
- Third-party creators (photographers, videographers, designers) sign work-for-hire or license agreements that clearly allocate rights
- Any brand deliverables use only the rights licensed under the specific brand agreement
Music, sports footage, and league IP in content are used only where properly licensed or where a clear fair-use basis exists. PROVN does not distribute content that infringes copyright, trademark, or publicity rights of third parties.
International Compliance
PROVN represents and communicates with athletes from outside the United States, including Ghana and other African nations, Canada, Europe, and the Caribbean. For international athletes, additional layers of compliance apply:
- US visa status and work authorization (F-1, P-1, O-1, or other applicable categories) must be confirmed before any revenue-generating activity
- Tax reporting and withholding obligations under US law and any applicable treaty
- Home-country federation and labor rules where relevant
- Home-country data protection regimes (for example, GDPR for European athletes)
PROVN coordinates with immigration counsel, tax advisors, and the athlete's home-country representatives where needed.
Mission & Financial Transparency
PROVN commits to supporting its stated mission partners, currently GO Ministries, GO Sports, and Freedom Hoops, through recurring contributions tied to revenue and agency activity. This commitment is:
- Disclosed in representation agreements
- Documented in internal financial records
- Subject to annual review and reporting to clients on request
- Not a substitute for or offset against amounts owed to athletes under their deals
Commission structures are disclosed in writing, are age and deal-type specific, and conform to league-maximum limits for professional contracts when that representation becomes active.
