This Privacy Policy describes how PROVN Sports (“PROVN,” “we,” “us,” or “our”), operating within the OpalKadia ecosystem, collects, uses, and protects personal information in connection with provnsports.com (the “Site”) and our sports representation services. PROVN is headquartered at 8900 State Line Road, Suite 430, Leawood, Kansas 66206.
By using the Site or submitting an inquiry, you acknowledge that you have read this Privacy Policy. If you do not agree with any part of this policy, please do not use the Site.
Information We Collect
We collect information that you voluntarily provide through our inquiry forms and communications, including:
- Contact information (name, email, phone, location, WhatsApp)
- Athlete information when submitted by the athlete, a parent, or guardian, including sport, level, school, graduation year, statistics, and biographical detail
- Parent or guardian information when the prospective athlete is a minor
- Business information for brand partners, capital partners, coaches, and media (company name, title, budget range, deal interest, story angle)
- Communication history and notes you share with us
We also collect limited technical information automatically when you visit the Site:
- Device and browser type, operating system, and language settings
- IP address and approximate geographic location
- Referral source and pages visited
- Session timing and interactions
How We Use Information
We use personal information for the following purposes:
- Responding to inquiries and fulfilling service requests
- Evaluating potential athlete representation, brand partnerships, and capital relationships
- Providing agency services to current clients, including contract negotiation, brand matching, and career development
- Complying with NIL rules, NCAA regulations, NFHS and state high school association rules, and applicable agent certification frameworks
- Operating, maintaining, and improving the Site
- Protecting against fraud, abuse, and unauthorized activity
- Meeting legal, tax, accounting, and regulatory obligations
Minors & COPPA
PROVN represents and communicates with high school athletes, many of whom are under 18. We take special care with information from or about minors.
- We do not knowingly collect personal information from children under 13 through the Site without verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA).
- Inquiries regarding prospective athletes who are minors must be submitted or consented to by a parent or legal guardian.
- Any representation relationship with a minor requires written parental or guardian consent and, where applicable, independent legal review.
- Parents and guardians may review, update, or request deletion of information about their minor child at any time by contacting connect@provnsports.com.
If we learn that we have inadvertently collected information from a child under 13 without proper consent, we will promptly delete it.
Data Retention & Security
We retain personal information for as long as necessary to fulfill the purposes described in this policy and to comply with our legal, tax, and regulatory obligations. Inquiry communications are typically retained for up to 36 months unless a representation relationship is established.
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee the security of information transmitted over the internet.
Your Rights
California Residents (CCPA / CPRA).You have the right to request access to, correction of, and deletion of personal information we hold about you. You also have the right to opt out of the sale or sharing of personal information, though PROVN does not sell personal information. To exercise these rights, email connect@provnsports.com with the subject line “Privacy Request.”
European Economic Area and UK Residents (GDPR). You have rights of access, rectification, erasure, restriction, portability, and objection regarding personal information we process about you. Our lawful bases for processing include consent, contract performance, legal obligation, and legitimate interests. You may lodge a complaint with your local data protection authority.
All Users. You may request a copy of information we hold about you, request correction of inaccurate information, withdraw consent to optional processing, and opt out of promotional communications at any time.
International Users
PROVN is headquartered in the United States. If you access the Site from outside the US (including Ghana, Canada, Europe, and other jurisdictions where our athletes live), your information may be transferred to and processed in the United States. By using the Site, you consent to this transfer.
We apply appropriate safeguards to international transfers, including contractual commitments with our service providers and recognized cross-border transfer mechanisms where applicable.
